Section 23
Code of Conduct Implementation and Monitoring
(1) According to section 22, regarding whether the code of conduct made by the commission has been complied with, the commission will investigate and monitor by establishing a mechanism as required.
(2) In the course of investigation or monitoring according to sub-section (1), if it is found that the code of conduct has not been followed or has been violated, the commission will order the relevant political party, candidate, person, organization, official or body to immediately stop or cancel such work.
(3) The commission may impose a fine of up to one lakh rupees on the political party, candidate, person, organization, official or agency that does not stop or cancel the action in accordance with the order given by the commission in accordance with sub-section (2).
(4) If the Commission is convinced that the election cannot be conducted in a free, fair and rigged manner due to a violation of the code of conduct made by the Commission, the Commission may cancel the candidature of such a candidate by giving clear grounds and reasons thereof. In this way, before canceling the candidature, the concerned candidate should be given a fair chance to clear himself.
